is it legal for the owner to take all the credit card tips

so i was told by the owner that we dont get credit card tips because they dont tax us on the cash…. i know thats not legal…. and i know i would make a lot more if i was getting taxed. i tried to talk to the owner about it and he said if i dont like it get a new job….well i dont like it but before i get a new job i want my money. how should i go about this.
