Please direct me towards the legal documentation from the Oregon Administrative Rules, BOLI, State or Fedral law that specifies who exactly is the ‘entitled’ persons for which gratuities are given, and please nothing that says owners or management can’t, we know that already. and if possible any legal documentation that clearly states that the gratuities collected are solely distributed by the primary server at their discretion to others that have also provided a service to the patron[anyone who carries foods, beverages,cleans or whatever the patron requires is considered a service provider]

Becuase Oregon is an “At Will” employment state, and because we do not have a “tip credit” system (like other parts of the country, where servers make half the federal minimum wage) tipped employees (in Oregon) have virtually no legal protection. Federal law gives employees discretion in distributing the tips they earn, but no such protection is afforded in Oregon law.
