Location: SF
have a friend that works for a restaurant in Pacific Heights. The owner steals tips from everyone there, and all the employee’s know this. The owner pays tips at the end of the week instead of every evening. Is this legit? On top of which; he abuses everyone with his shouting and verbal abuse!
Anyone know of a good pro bono lawyer?










Sure is legal! They can choose to pay your tips with your regular pay schedule. This is okay because of credit cards, the restaurant doesn’t get the money from the CC company for (in many cases) several days. So allowing staff to take the credit card tips is something like giving you a loan. If the customer later disputes the charge, the managment would have to ask you for that gratuity back - since the guest never paid it.
